Aim: To give participants an overall understanding of how the Mental Capacity Act applies to their day-to-day work settings.
Target Audience: This training is for Care Assessors, OTAs, Initial Contact Workers, Day Centre Officers, Business Support Officers & New Staff. Also, anyone working in a provider
setting, e.g. a care home, day centre, domiciliary care provider, supported living project, etc.
This is an awareness session, so it is suitable for people who want to gain a general understanding of what the Act is all about.
Course objectives:
- Be familiar with the background to the act and understand why we need the Mental Capacity Act and DoLs.
- Know the definition of Mental Capacity.
- Understand who is covered by the Act and how it applies to the people we work with.
- Know who can assess for Mental Capacity and understand the different levels of decision making.
- Understand the functional test for capacity.
- Know the 5 statutory principles and how to support a person to make their own decisions.
- Be aware of the House of Lords review of the implementation of the MCA.
- Understand the importance of the Safeguarding agenda when working with MCA issues and how the 2 areas are linked.
- Be familiar with Advance Decisions and Lasting Power of Attorney.
- Understand the roles of the Court of Protection and the Office of the Public Guardian.
- Understand when a decision must be taken to the Court of Protection.
- Know what the role of an Independent Mental Capacity Advocate is and when to bring one in.
- Importance of recording evidence-based decisions in relation to MC and MCA.
- Have a basic understanding of the Deprivation of Liberty Safeguards.
- Have an understanding of the March 2014 Court of Appeal judgements around the Deprivation of Liberty Safeguards and have looked at the coming amendments to the DoLs framework.
